Terms of service

MonBien is an online platform that publishes real estate listings in the DRC and connects people looking for a property with the agents who offer it.

MonBien is not a party to any sale or rental. We do not own the properties, we do not set prices, and we do not receive the money from a sale or a rent. The agreement is made directly between you and the agent or owner.

You must be 18 or older. The information you give us (forms, account) must be accurate.

• You are responsible for your account and everything done with it. Keep your password secret.
• Your name, contact details and profile must be accurate. Do not pretend to be another person or agency.
• If you think someone is using your account, tell us right away.

By publishing a listing, the agent confirms that:

• they have the right to offer this property (mandate or owner’s agreement);
• the property exists and is available;
• the price, location, description and photos are accurate and up to date;
• they have the right to use the photos and videos they publish;
• they remove or update the listing as soon as the property is sold or rented.

The agent allows us, free of charge and non-exclusively, to display, resize and share their listings and profile on the site, on social media and in our ads, for as long as the listing is online. The agent keeps ownership of their content.

We may fix the formatting of a listing, refuse it, or remove it if it breaks these rules or seems misleading.

MonBien creates some listings from posts that agents made public, for example on social media. These listings carry a special label. The agent can take over the listing with a MonBien account, or ask us to remove it at any time.

• Publishing a fake or duplicate listing, or a listing for a property you have no right to offer.
• Asking for money (advance, viewing fee, reservation) for a property that does not exist or is not available.
• Harassing, threatening or deceiving other users.
• Using contact details found on the site to send unsolicited marketing messages.
• Copying the site’s content in bulk, or trying to get around the site’s security.

We may suspend or delete an account that breaks these rules, and report fraud to the authorities.

We cannot check every listing. Before you pay anything, visit the property, meet the person and check the documents. Never pay in advance for a property you have not seen.

A “verified” badge on an agent or a listing means only the checks described on the site. It is not a guarantee about the property or the transaction.

Browsing listings and publishing listings as an agent are free today. MonBien may offer paid options later, for example featuring a listing. We will announce prices in advance, and nothing will be charged without your agreement.

• After your request, we send you a quote. Work starts only once you have accepted the quote in writing.
• The report describes what we found on the date of the checks: registers, cadastre, the plot and its neighborhood. It also depends on information given by the authorities and by the people we meet.
• The report is not a guarantee of ownership and not legal advice. It does not replace a notary or a lawyer.
• If you cancel before the on-site checks start, we refund you. Once the on-site checks have started, no refund is possible.
• Our liability for this service is limited to the amount you paid for it.

The MonBien name, logo, design and site text belong to MonBien. You may not copy or reuse them without our written permission.

The site links to other services, for example WhatsApp or Facebook. These services have their own rules, and we are not responsible for them.

The site is provided as is. We do our best to keep it working well, but we do not guarantee that it is always available or free of errors.

To the extent the law allows, MonBien is not responsible for content published by agents, for their conduct, or for agreements made between users. Our total liability to you does not exceed the amounts you paid us in the last 12 months.

An agent can ask to close their account at any time by writing to [email protected]. Their listings are then removed from the site. We may suspend or close an account that breaks these terms.

We may change these terms. The date at the top of the page shows the latest version. If we make an important change, we will say so on the site. If you keep using the site, you accept the new version.

These terms exist in French and English. If the two differ, the French version prevails.
